PPI refunds cannot be based on 'half mis-sold' policies

People who feel they have been falsely sold payment protection insurance (PPI) may face difficulty getting a refund if the only half of a policy's premiums related to a mis-sold policy, according to research by

The website's Simon Moon examined the case of an individual who was sold by Abbey a policy combining unemployment cover with accident and sickness protection. When the person discovered that the unemployment element had been mis-sold, they faced difficulties making a claim as money had already been paid out on the sickness part of the policy.

According to Moon, the Financial Ombudsman Service does not accept the notion that a policy can be 'half mis-sold', which makes it difficult for people in this position to make a PPI claim.

However, individual circumstances differ and it is possible that a PPI refund may be available if the policy holder can argue that it was inappropriate for their circumstances.

Currently, the Financial Services Authority wants more than 185,000 PPI claims to be re-examined, dating back to 2005.
