Scottish consumers dealt fresh bank charges refund blow

Scottish consumers keen to sue over unfair bank charges have been dealt a blow in a landmark court case.

Until this week, it had been the case that any customer keen to take a high street bank to court in a bid to be refunded for overdraft charges would have been directed to small claims courts.

However, a Glasgow sheriff has now sided with banking giant Santander, which has been arguing for some time that such cases are too complicated to be dealt with at this level.

As such, consumers fighting back against bank charges will now be required to go through the costlier and more time-consuming process of fighting their corner in the country's sheriff's courts, meaning many could decide not to go through with their claims.

Commenting on the development, Mike Dailly of the Govan Law Centre, told the Scottish Herald newspaper that the risk of being landed with costs of up to £10,000 should their claim fail will deter many consumers from following through with their grievances.

"For those ineligible for legal aid it would be crazy to proceed," he said.

"The strategy is clearly designed to deliver a death blow to consumers' claims."

This comes just a couple of weeks after reported that Britons are racking up charges of £900 million each year as a result of using their credit cards overseas.
